Overview
Upon completing a search and submitting payment to begin the lease takeover process, Leaseway, LLC (“us”, “we” “our” or “Leaseway”) holds such users’ (the “Interested Party”) payment until the connection is indicated as completed by the Interested Party, the Interested Party disputes the order, or the party turning over the lease (the “Relinquishing Party”) actions a refund to the Interested Party. All actions stated are completed via the ‘order’ in the order dashboard.
Leaseway is simply a platform connecting people to simplify the lease takeover process, and is not responsible for paying rent for any listing. Once the ‘connection’ between Interested Party and Relinquishing Party is bought, the process to turn over the lease begins. The Relinquishing Party is given twenty-four (24) hours to contact the Interested Party and connect the Interested Party and property manager. If no contact is made by the Relinquishing Party within this time frame, Interested Party should contact Leaseway and we will send an email to the Relinquishing Party, and they will have three (3) days to respond from the day of our email being sent before we issue a full refund to the Interested Party.
If the Relinquishing Party no longer wishes to post their lease, they can take it down prior to a takeover request being made. If a takeover request was made, they can issue a refund on their order dashboard.
If the Relinquishing Party is believed to be Sabotaging this process, then the Interested Party should dispute the order in their order dashboard. Leaseway will make a determination in its sole discretion, and Interested Party may be entitled to a full refund. The Relinquishing Party can attempt to post again but will be Flagged in our database in the event of another Sabotaging incident.
If the Interested Party is believed to be Sabotaging the process and there is no evidence of the Interested Party messaging the Relinquishing Party for a refund, then the Relinquishing Party should contact Leaseway and we will decide who is in the wrong. Based on the severity of the situation, the Interested Party may only be entitled up to a 80% refund. The Relinquishing Party would be entitled to the remaining 20% minus any commissions and fees from Leaseway or its payment providers.
If the Interested Party does not pass the credit background, and/or income check that may be carried out by the property manager, the Interested Party may only be entitled up to a 90% refund. The Relinquishing Party would be entitled to the remaining 10% minus any commissions and fees from Leaseway or its payment providers.
If the property manager is at fault for lack of communication (not responding to the Interested Party within 5 business days) the Interested Party can either ask the Relinquishing Party to issue a refund (which will result in a faster way of being refunded) or dispute the order (in which we’d be in communication with both parties to make sure the refund is warranted.)
After signing the contract for the lease takeover, a refund is no longer eligible as the Interested Party has already signed an obligation to commit to rent the property with the property manager. The Interested Party must speak with their property manager about what to do if they decide they no longer want to live there after signing the lease. If another lease takeover is allowed by the property manager, you can use Leaseway to post your lease for connection.
“Flagged” shall mean an internal notation by Leaseway of a party’s intentionally failing to comply with the lease takeover, as determined by Leaseway in its sole discretion. In the event of two (2) incidences of a party being Flagged, such party’s account will receive a permanent ban.
“Sabotaging” shall mean halting the lease takeover process by not providing information or not being able to communicate in a timely manner with either the Interested Party and the property manager and/or the Relinquishing Party. Leaseway will provide a five-day period of no communication from the initial message before considering a refund.
